Confirm facility access and any attorney, document-preparer or witness instructions before scheduling.
How do you confirm that a signer is aware and signing willingly?
For every notarization, Dina Mahshi-McWashington interacts directly with the signer to confirm identity and assess whether the signer is participating willingly and is sufficiently aware of the notarial act taking place. This direct interaction is especially important during estate planning appointments at private homes, hospitals, senior communities and care facilities. The signer must be able to communicate directly with the notary and provide identification that satisfies California notarial requirements. If a loved one tends to be more alert or communicative at certain times of day, scheduling the appointment during those times can help create the best conditions for the signing. A California Notary Public does not make a medical diagnosis or legal determination of capacity. If the signer cannot communicate directly with the notary, appears unaware of the notarial act, is unwilling to proceed, or appears to be acting under pressure or coercion, the notarization may not be completed.
Can a document be notarized if the signer cannot physically sign their name?
Yes, in some circumstances. California provides a procedure known as a signature by mark for a signer who cannot write their name. A mark, such as an X, may be used as the signer’s signature when the applicable California requirements are followed. A signature by mark requires additional witnesses and specific signing and notary-journal procedures, so please mention this when scheduling the appointment so the visit can be properly coordinated. The signer must still personally participate in the notarial act, provide satisfactory evidence of identity, and communicate directly with the notary.
Can the notary also serve as one of the witnesses at my appointment?
Possibly. A California Notary Public may also serve as a witness in some circumstances, but whether that is appropriate depends on the document and the instructions provided by the attorney or document preparer. Can the notary help me find witnesses for my appointment?
Yes. Eagle Eye Mobile Notary offers witness coordination with advance notice. If the attorney or document preparer has indicated that witnesses are required, witness coordination can be added to the appointment to help ensure the required people are present when the signing takes place. The attorney or document preparer should provide the applicable witness requirements, including any eligibility requirements. Eagle Eye Mobile Notary coordinates the witnesses but does not determine whether witnesses are legally required or who is legally eligible to serve.
Does a California will need to be notarized?
California wills generally rely on signing and witness requirements rather than notarization for validity. Eagle Eye Mobile Notary does not determine the execution or witness requirements for a will. What happens to a Power of Attorney after someone passes away?
A Power of Attorney generally does not give an agent continuing authority to act for the principal after the principal’s death. If you are trying to determine who has authority to handle a loved one’s financial, property, trust or estate matters after death, contact the estate planning attorney or other qualified legal professional for guidance. Eagle Eye Mobile Notary can assist with requested notarizations on properly prepared documents but cannot determine who has legal authority to act on behalf of an estate or trust.
My parent has estate planning documents that need to be signed. Can I schedule the appointment for them?
Yes. A family member, attorney, caregiver or other representative may contact Eagle Eye Mobile Notary to coordinate the appointment. However, the signer must personally participate in the notarization and communicate directly with Dina during the appointment. Before scheduling, please confirm that the documents are complete and obtain any signing, notarial or witness instructions from the attorney or document preparer. Family members and caregivers may assist with appointment logistics, but they cannot answer questions or make decisions on the signer’s behalf during the notarial act.
