These Terms & Conditions (“Terms”) govern the use of the Eagle Eye Mobile Notary website and services provided by Eagle Eye Mobile Notary (“Eagle Eye,” “we,” “our,” or “us”). By using this website, scheduling an appointment, or engaging Eagle Eye Mobile Notary for services, you acknowledge and agree to these Terms.

1. Services

Eagle Eye Mobile Notary provides mobile and related professional services, which may include:

  • California notarial services
  • Loan signing services
  • Estate planning document signing appointments
  • Apostille courier and document facilitation services
  • Ink and roll fingerprinting
  • Mobile document scanning
  • Witness coordination when requested and available
  • Other document-related services agreed upon in advance

Availability, pricing, geographic coverage, and service requirements may vary depending on the appointment and requested service.

Eagle Eye Mobile Notary reserves the right to decline a service that cannot lawfully or appropriately be performed.

2. Role of the Notary Public

A California Notary Public is an impartial witness whose duties are governed by California law.

The notary’s role may include verifying the identity of a signer, determining the signer’s willingness and awareness, administering an oath or affirmation when required, completing the appropriate notarial certificate, and maintaining required notarial records.

A notarization does not establish that a document is truthful, legally valid, enforceable, or suitable for its intended purpose.

Completion of a notarization is always subject to the notary’s independent determination that all requirements of California law have been satisfied.

3. No Legal Advice

Eagle Eye Mobile Notary and Dina McWashington are not attorneys and do not provide legal advice or legal representation.

We cannot select a notarial act for a customer, determine which document a customer should use, prepare legal documents unless otherwise legally authorized, interpret the legal effect of a document, or advise a customer regarding legal rights or consequences.

Questions concerning the preparation, meaning, validity, or legal effect of a document should be directed to a licensed attorney or the appropriate document-issuing or receiving agency.

4. Identification Requirements

Signers requesting notarization must present satisfactory evidence of identity that complies with applicable California law.

Acceptable identification depends on the circumstances and requirements of California notary law. Examples may include a California driver’s license or identification card, a United States passport, qualifying foreign passport, qualifying driver’s license or identification card issued by another U.S. state, or other forms of identification permitted by California law.

Certain identification documents may qualify if current or if issued within the period permitted by California law.

It is the customer’s responsibility to have appropriate identification available at the appointment.

If satisfactory evidence of identity cannot be established, the notarization cannot be completed.

5. Personal Appearance, Awareness, and Willingness

A signer must personally appear before the notary as required by California law.

The notary must be reasonably satisfied that the signer is communicating willingly and is sufficiently aware of the nature of the transaction requiring notarization.

Eagle Eye Mobile Notary may decline or discontinue a notarization if the notary has concerns regarding identity, willingness, awareness, coercion, fraud, document completeness, or compliance with applicable law.

6. Document Readiness

Customers are responsible for ensuring that documents are complete and ready for signing before the appointment unless another arrangement has been made.

The notary cannot determine whether a document is legally sufficient or advise a customer regarding how a document should be completed.

Documents containing blanks or other circumstances that prevent lawful notarization may be declined.

Customers should contact the document preparer, attorney, title company, escrow company, lender, receiving agency, or other appropriate party with questions regarding document content or completion.

7. Scheduling and Appointment Information

Appointments may be scheduled by telephone, online booking, contact form, text message, email, or another approved method.

Customers are responsible for providing accurate appointment information, including the service requested, location, number of signers, anticipated documents or notarizations, and any special circumstances that may affect the appointment.

An appointment request is not necessarily confirmed until confirmation is provided by Eagle Eye Mobile Notary.

Online scheduling may be provided through a third-party booking service. Use of that service may also be subject to the provider’s terms and privacy practices.

8. Fees and Payment

Fees may include notarial fees permitted by California law as well as separate charges for travel, convenience, printing, scanning, courier services, fingerprinting, witness coordination, document handling, after-hours appointments, or other non-notarial services.

Any travel, convenience, administrative, courier, printing, scanning, or other service fee is separate from the fee charged for a notarial act.

Where practicable, applicable service and travel fees will be disclosed or agreed upon before the appointment.

Payment is due at the time services are rendered unless other arrangements have been made in advance.

Accepted payment methods may vary.

9. Travel and Mobile Service Fees

Eagle Eye Mobile Notary is a mobile service. Travel or convenience fees may apply based on location, distance, appointment timing, service requirements, parking, tolls, or other circumstances.

Travel and other non-notarial service fees are separate from California notarial fees.

A travel or service fee may still be due when the notary travels to an appointment but the requested notarization cannot be completed because of circumstances outside the notary’s control, including lack of satisfactory identification, an absent signer, an incomplete document, a signer who is unwilling or unable to proceed, or another legal impediment to notarization, provided the fee was disclosed or agreed upon as applicable.

10. Cancellations and No-Shows

Customers should provide at least two hours’ notice when cancelling or rescheduling an appointment.

A cancellation, travel, or service fee may apply to late cancellations, no-shows, or appointments where the notary has already begun traveling or arrived at the agreed location.

Any applicable cancellation or travel fee will be based on the circumstances of the appointment and any fee disclosed or agreed upon when the service was scheduled.

11. Mobile Scanning

When mobile document scanning is requested and available, scanning fees are separate from notarial, travel, and other service fees. Applicable scanning fees will be disclosed or agreed upon before the service is performed.

Customers are responsible for identifying the intended recipient and confirming any transmission requirements.

12. Loan Signing and Real Estate Transactions

For loan signing, escrow, title, and real estate appointments, Eagle Eye Mobile Notary acts as an independent notary/signing professional and does not represent the lender, title company, escrow company, settlement agent, or borrower unless expressly stated otherwise.

Questions regarding loan terms, interest rates, fees, funding, escrow instructions, title matters, or the legal or financial effect of transaction documents must be directed to the appropriate lender, title, escrow, settlement, or legal professional.

13. Apostille Services

Eagle Eye Mobile Notary may provide apostille courier and document facilitation services.

Eagle Eye Mobile Notary does not issue apostilles and cannot guarantee that the California Secretary of State, another governmental authority, embassy, consulate, or receiving agency will authenticate or accept a particular document.

Processing times and acceptance decisions are controlled by the applicable government or receiving authority and may change without notice.

14. Ink and Roll Fingerprinting

Ink and roll fingerprinting services involve capturing fingerprints on an appropriate fingerprint card supplied by the customer or otherwise arranged for the appointment.

Customers are responsible for confirming with the requesting agency which fingerprint card, identification, number of cards, and other requirements apply to their particular submission.

Eagle Eye Mobile Notary does not guarantee that a requesting agency will accept a fingerprint card or that fingerprints will produce a particular background-check result.

15. Witness Coordination

When requested, Eagle Eye Mobile Notary may assist with coordinating witnesses for an appointment.

Witness availability is not guaranteed unless confirmed in advance. Customers remain responsible for confirming any legal or document-specific witness requirements with the document preparer, attorney, or receiving agency.

The notary does not determine whether a proposed witness satisfies requirements that involve legal interpretation.

16. Third-Party Services and Links

The website may contain links to or integrate with third-party services, including scheduling, mapping, payment, analytics, or other service providers.

Eagle Eye Mobile Notary is not responsible for the availability, content, security, privacy practices, or independent actions of third-party websites or services.

Use of third-party services may be subject to their own terms and privacy policies.

17. Website Information

Information provided on this website is for general informational purposes only and is not legal, financial, tax, or other professional advice.

We make reasonable efforts to maintain accurate and current information but do not warrant that every website statement will always be complete, current, or error-free.

Service descriptions, availability, pricing, policies, and website content may be updated from time to time.

18. Intellectual Property

Unless otherwise stated, the text, branding, graphics, photographs, design elements, and original content appearing on this website are owned by or licensed to Eagle Eye Mobile Notary and may not be reproduced, distributed, modified, or used for commercial purposes without permission, except as permitted by law.

19. Prohibited Website Use

Users may not use the website to engage in unlawful activity; interfere with website operation or security; attempt unauthorized access to systems or data; transmit malicious code; impersonate another person; or use website content or functionality in a manner that violates applicable law or the rights of others.

20. Limitation of Liability

To the fullest extent permitted by applicable law, Eagle Eye Mobile Notary will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or services.

Eagle Eye Mobile Notary is not responsible for delays, rejection of documents, governmental processing times, third-party actions, transaction outcomes, or consequences arising from inaccurate or incomplete information supplied by a customer or another party.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

21. No Guarantee of Outcome

Eagle Eye Mobile Notary does not guarantee that a notarized, signed, fingerprinted, scanned, couriered, or otherwise processed document will be accepted by a particular court, agency, lender, title company, foreign government, recipient, or other third party.

We will perform agreed services with reasonable care and in accordance with applicable requirements within the scope of the services provided.

22. Privacy

Use of the website and services is also subject to the Eagle Eye Mobile Notary Privacy Policy, which describes how personal information may be collected, used, disclosed, and protected.

23. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any dispute concerning these Terms or services provided by Eagle Eye Mobile Notary will be subject to applicable California law and any court of competent jurisdiction.

24. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

25. Changes to These Terms

Eagle Eye Mobile Notary may update these Terms periodically to reflect changes in services, business practices, website functionality, or applicable requirements.

The current version will be posted on the website with an updated Effective Date.
